I'll be honest, I know nothing about how fun, or not, this new product is. What I do know is there is no need for any app for children to require location services to be activated - to even use the product. Did you not know this set works (only works) with a partnered app? My child has an Amazon Fire tablet that, because Amazon made a safe product, disables location services for their children's' devices. In order to pair the Lego Mario with the app, via Bluetooth - no problem, works great, the device will not pair with the Mario figure until you enable location services (GPS) for the app. That's not even an option on a child's profile, at least not on the Fire. And why should it be?
