So I get my $25 mattress topper, unfurl it and all is good. It's comfy and doesn't smell. Then I got around to reading some of the little cutesy things in the nicely designed instructions / about us packet that were in the box. Pull out the yellow slip of paper titled "STOP-Please read me!" It purports to tell me about my legal rights regarding the purchase of my mattress topper. "Dispute Resolution through Arbitration" followed by "This is a binding legal agreement between you and Zinus." Goes on to tell me all the terms and conditions of my buying their topper including that any disputes must go to arbitration and in order to OPT OUT of binding arbitration I have to actively send them my info. As someone who has dealt with consumer law for years (not as an attorney but doing all forms of executive level marketing, sales and licensing), this piece of paper is NOT binding, NOT enforceable and NOT an agreement of any sort. Adding terms and conditions after the sale is not legal under any construct. Purchasers do not give up their rights because a piece of paper in the box says they do. You cannot have an agreement unless both parties AGREE to it (either verbally or in writing). Making a condition OPT OUT only is like adding stupid onto insane. Even worse, Zinus is headquartered in California where they take an even dimmer view of after the fact terms and conditions. So here's my professional advice Zinus. Don't be idiots and spoil what seems to be a decent product with something meaningless legally and will only annoy your new customer. Be adult and take the car keys away from whoever gave you this bad legal advice or encouraged you to do this. Until then, one star for the mega sleeze factor. I doubt even used car salesmen would stoop to this.
